In order to register with Every Baby Has a Story you must agree to the Every Baby Has a Story and the Scrapblog, Inc. Terms of Use and Privacy Policies which are described below.
Please remember that any photos or videos you publish on the Every Baby Has a Story site will be available on the Internet.
Terms of Use
Registering with Every Baby Has a Story gives you the opportunity to create multimedia scrapbooks, or "scrapblogs"™, that you can upload onto the Every Baby Has a Story web site (the "Service"). The technology used to create your "scrapblog" is provided by Scrapblog, Inc. ("Scrapblog") under a license to the March of Dimes. By registering with Every Baby Has a Story, you agree to be bound by the following Terms of Use.
You understand that by publishing any images, graphics, videos, messages, text or other content or materials (collectively, "Submission") on the Every Baby Has a Story web site, the contents of your Submission will be publicly accessible over the Internet. People viewing your Submission will also see your name, your baby's name, your city, state and postcode and (if you are an international user) your province and country.
If you create a video on the Every Baby Has a Story motor coach, your video will be uploaded onto YouTube and the Every Baby Has a Story web sites and visible to anyone visiting those sites.
March of Dimes does not guarantee any confidentiality with respect to your Submission.
General terms
You represent that you are 13 years or older, and that, if you are younger than 18 years of age, you have the consent of your parent or legal guardian to agree to these Terms of Use and to our Privacy Policy.
You accept sole responsibility for all of your activities on the Every Baby Has a Story web site, including your conduct on the site and any and all content you may submit, post or share via the site.
You accept sole responsibility for keeping your password secure.
You will not upload, link to, post, email, transmit or otherwise make available any photo, video or other content that is libelous, defamatory, obscene, fraudulent, harmful, threatening, abusive or hateful, that violates the property rights of others (including without limitation infringing use of a copyright or trademark), that violates the privacy or publicity right of others, or that is in violation of applicable laws.
You will not interfere with other users' use and enjoyment of this site.
You will not use this site to conduct any activity that is illegal or that violates the rights of others.
You will not use the Every Baby Has a Story Service or web site to advertise or sell products or services to others.
You will not upload or transmit viruses, worms or any other destructive code.
You accept the terms of our Privacy Policy, which is set forth below following these Terms of Use.
Your submissions
By publishing your Submission, you hereby:
1) grant to the March of Dimes an irrevocable, non-exclusive, royalty-free license to exhibit, reproduce, publish, or distribute, your Submission and any videos, images, photographs and/or personal stories used in creating the Submission, at any time, locally regionally, nationally or world-wide in any form of communication, including over the internet and through online services such as YouTube™ and flickr,™ to prepare derivative works of your Submission, and to use the Submission for educational, public relations, fundraising and other purposes in furtherance of the March of Dimes mission.
2) warrant that you own or have the necessary licenses to use, and to authorize the March of Dimes to use, your Submission, including any videos, images, photographs and/or personal stories in the manner contemplated by these Terms of Use.
3) release and discharge the March of Dimes from any claims or demands in any way relating to the use of your Submissions, including the use of any images, graphics, photographs, videos, and/or text.
March of Dimes respects the intellectual property of others, and it is our policy to respond to claims of alleged infringement. If you believe that your work has been copied in a way that infringes your copyrights, please email us at Everybabyhasastory@marchofdimes.com and provide all relevant details.
March of Dimes is not responsible for and does not review the images, graphics, video messages, blogs, text or other content or materials provided by Every Baby Has a Story users. However, March of Dimes reserves the right to delete Submissions that the March of Dimes deems, in it sole discretion, unacceptable for any reason. March of Dimes makes no representation that it can protect its users from exposure to offensive material. March of Dimes is not liable for the content of any user Submission and expressly disclaims all liability relating thereto.
March of Dimes Content
As a registered user, you may use certain content in your creations that the March of Dimes provides to you free of charge, which may include, at the discretion of the March of Dimes, graphics, photographic images, videos, fonts, and other content. All right, title, and interest in and to this content are and will remain the exclusive property of the March of Dimes and its licensors.
The Submissions of other users of the Service are made available to your only for your information and personal use and may not be used, copied, reproduced, distributed, broadcast, displayed, sold, licensed, downloaded or otherwise exploited in any manner other than in the normal use of the Service.
Online Sharing through Third Party Services
The Every Baby Has a Story Service enables you to share your creations through third party websites, blogs or email systems. When sharing your creations through third party services you shall continue to comply with these Terms of Use. You are also to comply with the terms of the services through which you are sharing your creation.

Every Baby Has a Story may link its web sites to, or third parties may provide, links to third party web sites and materials. March of Dimes has no control over such sites and materials. You acknowledge and agree that the March of Dimes does not endorse and is not responsible or liable for any content, software, advertising, products or other materials on or available from such sites. You further acknowledge and agree that the March of Dimes shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such images, content, software, goods or services or other material available on or through such third party web sites and materials.
Indemnification
You agree to indemnify, defend and hold the March of Dimes, our officers, directors, employees, agents, licensors, suppliers and any third-party information service providers to the Every Baby Has a Story Service harmless from and against all claims, liabilities, losses, expenses, damages and costs, including reasonable attorney's fees, resulting from (i) any violation of these Terms of Use, or any activity related to access to or use of your account (including negligent and wrongful conduct) by you or any other person accessing the service using your account and/or (ii) a claim that a Submission infringes third party intellectual property rights.

The March of Dimes disclaims any and all responsibility or liability for the content, legality, reliability, or operability or availability of information or material displayed on the Every Baby Has a Story web site. The March of Dimes disclaims any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of any photos, contents, information or other material. The March of Dimes disclaims any responsibility for any harm resulting from downloading or accessing any information or material on the Internet through the Every Baby Has a Story Service.

You acknowledge that the March of Dimes may from time to time change the services offered, including, without limitation, the maximum number of days that a Submission will be retained, the number and frequency of Submissions that may be sent from or received by an account, the maximum size of any Submissions that may be sent from or received by an account, the maximum disk space that will be allotted on the Every Baby Has a Story servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that the March of Dimes has no responsibility or liability for the deleting or failure to store any Submissions and other content or materials maintained or transmitted by the Service. You further acknowledge that the March of Dimes reserves the right to modify these general practices and limits from time to time.

What Information We Collect
To create an account and start making scrapblogs, you need to submit a valid email address and create a password. We will also ask you to provide your first and last name, your baby's first and last name, your baby's date of birth and your city, state and postcode, and (if you are an international user) your province and country.
The Every Baby Has a Story web site uses cookies to make it easy for you to navigate our site and so we can improve your experience when using the site. In the future, Scrapblog may offer additional premium content, services and printed merchandize, which you can access or order on a paid basis. However, it is our intention to keep the current service free of change.
General terms

You acknowledge that Scrapblog may from time to time upon prior written notice to you change the services offered, including, without limitation, establish general practices and limits concerning use of the Service the maximum number of days or maximum amount of Submissions will be retained by the Service, the amount and frequency that Submissions may be sent from or received by an account on the Service, the maximum size of any Submissions that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on Scrapblog's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time, and charge for services that Scrapblog may have previously offered without charge. You agree that Scrapblog has no responsibility or liability for the deleting or failure to store any Submissions and other content or materials maintained or transmitted by the Service. You further acknowledge that Scrapblog reserves the right to modify these general practices and limits from time to time.
